Michigan’s earned sick time act (ESTA)
Whether you are frustrated, confused, or overwhelmed by the last minute nature and whiplash of the Michigan legislature’s changes to Earned Sick Time Act (ESTA), having to implement a new policy, or having to account for a new complication to running a business, you are absolutely not alone. Even if you are very comfortable in your “HR Hat”, this one can be a tough read.
Essentially, ESTA comes from a good place (providing employee’s in the state of Michigan access to paid sick leave) but was originally, and arguably still is made more complicated by some of its blanketing language.
The simplest way to put where you fall in compliance is as follows:
Employers with 10 employees or fewer must:
Comply by October 1st, 2025.
Post the compliant language of their policy in both English and Spanish, as well as any other first language spoken by more than 10% of the current workforce.
Provide 1 hour of paid sick leave per 30 hours worked up to a maximum of 40 hours per year.
Employers with 10 employees or more must:
Comply by February 21st, 2025.
Post the compliant language of their policy in both English and Spanish, as well as any other first language spoken by more than 10% of the current workforce.
Provide 1 hour of paid sick leave per 30 hours worked up to a maximum of 72 hours per year.
Obviously these bullets only account for a small amount of the actual requirements to comply.
